Agreement to Terms

By accessing and using the services of Winterfaring Singapore Green Home Improvement Services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

1. Definitions

  • "Company," "we," "us," or "our" refers to Winterfaring Singapore Green Home Improvement Services
  • "Customer," "you," or "your" refers to the individual or entity using our services
  • "Services" refers to all home improvement services, consultations, and related activities provided by the Company
  • "Website" refers to winterfaring.com and all associated web properties
  • "Agreement" refers to these Terms of Service and any associated service contracts

2. Services Provided

Winterfaring provides green home improvement services including but not limited to:

  • Solar panel installation and maintenance
  • Energy-efficient insulation systems
  • Smart home integration and automation
  • Green roofing solutions
  • Water conservation systems
  • Home energy audits and consulting

All services are subject to separate written agreements that will specify the scope, timeline, pricing, and specific terms for each project.

3. Consultations and Estimates

We offer free initial consultations and estimates. However:

  • Estimates are valid for 30 days from the date provided
  • Final pricing may vary based on site conditions and customer requirements
  • Detailed engineering assessments may require additional fees
  • Estimates do not constitute a binding agreement until a formal contract is signed

4. Contracts and Payment Terms

Service Agreements

All projects require a signed written agreement that includes:

  • Detailed scope of work and specifications
  • Project timeline and milestones
  • Total cost and payment schedule
  • Warranty and maintenance terms
  • Terms for changes or modifications

Payment Terms

  • Typical payment schedule: 30% deposit, 40% at project midpoint, 30% upon completion
  • Payments are due within 14 days of invoice date
  • Late payments may incur interest charges of 1.5% per month
  • Work may be suspended for overdue payments
  • All payments must be in Singapore Dollars unless otherwise agreed

5. Customer Responsibilities

Customers are responsible for:

  • Providing accurate information about their property and requirements
  • Obtaining necessary permits and approvals (where specified in the agreement)
  • Ensuring safe and reasonable access to work areas
  • Protecting personal property not related to the project
  • Timely payment according to the agreed schedule
  • Compliance with HOA, condo board, or local regulations
  • Notification of any changes to property conditions or requirements

6. Warranties and Guarantees

Workmanship Warranty

We provide warranties on our workmanship as follows:

  • General installation work: 2 years
  • Electrical work: 5 years
  • Structural modifications: 5 years
  • Solar panel installations: 10 years on installation, 25 years on panels

Product Warranties

Product warranties are provided by manufacturers. We will assist with warranty claims but are not responsible for manufacturer defects or warranty terms beyond our control.

Warranty Limitations

Warranties do not cover:

  • Damage due to misuse, negligence, or acts of nature
  • Normal wear and tear
  • Modifications made by others
  • Failure to follow recommended maintenance
  • Issues arising from customer-provided materials or specifications

7. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability for any claim will not exceed the amount paid for the specific service
  • We are not liable for indirect, consequential, or punitive damages
  • We are not liable for delays due to weather, permit issues, or circumstances beyond our control
  • Claims must be reported within 30 days of discovery
  • Any legal action must be commenced within one year of the incident

8. Insurance and Safety

We maintain appropriate insurance coverage including:

  • General liability insurance
  • Workers' compensation insurance
  • Professional indemnity insurance
  • Equipment and materials coverage

Customers are advised to notify their insurance providers of any home improvements and verify coverage.

9. Permits and Regulations

Unless otherwise specified in the service agreement:

  • Customers are responsible for obtaining necessary permits
  • We will assist with permit applications when contracted to do so
  • All work will comply with applicable building codes and regulations
  • Additional costs may apply for regulatory compliance changes during the project
  • Permit delays may affect project timelines

10. Cancellation and Changes

Customer Cancellation

  • Cancellation before work begins: Full refund minus 10% administrative fee
  • Cancellation after work begins: Customer pays for completed work plus materials ordered
  • Custom or special-order materials may not be refundable

Project Changes

  • All changes must be approved in writing
  • Changes may affect timeline and cost
  • Additional work will be charged at prevailing rates

11. Intellectual Property

All designs, specifications, and proprietary methods remain the intellectual property of Winterfaring. Customers receive a license to use these materials only for their specific project.

12. Force Majeure

We are not liable for delays or inability to perform due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, severe weather, or acts of God
  • Government actions, regulations, or permit delays
  • Labor strikes or material shortages
  • Pandemics or public health emergencies
  • Utility company delays or failures

13. Privacy and Data Protection

We respect your privacy and handle personal information in accordance with our Privacy Policy and Singapore's Personal Data Protection Act. By using our services, you consent to our collection and use of information as described in our Privacy Policy.

14. Dispute Resolution

In the event of a dispute:

  • We encourage direct communication to resolve issues amicably
  • Unresolved disputes may be referred to mediation
  • Legal proceedings will be governed by Singapore law
  • Disputes will be subject to the exclusive jurisdiction of Singapore courts

15. Modification of Terms

We reserve the right to modify these terms at any time. Changes will be effective upon posting on our website. Continued use of our services constitutes acceptance of modified terms. For ongoing projects, changes will apply only to new agreements.

16. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.
